Ngilari Still Adamawa Dep Gov—Nyako Speaks

Ejected governor of Adamawa State, Murtala Nyako, has reacted to his removal from office by the State House of Assembly on Tuesday afternoon.

Nyako, in a press statement issued by his Director of Press and Public Affairs, Ahmad Sajoh, disclosed that “in the eyes of the law, the deputy governor (Bala James Ngilari) has not resigned.”

Ngilari was said to have tendered his resignation letter to the Assembly before the governor was impeached. Nyako argued that normally, his deputy is not expected to tender his resignation letter to the Assembly while he remained as governor.

The statement said, “as of the time the supposed resignation was said to have been tendered in the House, Murtala Nyako was the Governor of Adamawa State.”

Nyako, who accepted his fate, further argued that he wishes, “to state categorically that Section 306 (5) of the Constitution of the Federal Republic of Nigeria 1999 as Amended requires that the deputy governor resigns not to the House of Assembly but to the governor.”

He stressed that, “no such letter was written to him, none was received by him and none was approved by him,” and pointed out that, “Bala James Ngillari is still the Deputy Governor of Adamawa State.”

Nyako emphasised that, “this clarification is necessary to avert another subversion of the Constitution since the other processes relating to the impeachment saga have all been in contravention of the Constitution and the Law.”

Nyako was removed from office on allegation of gross and financial misconducts.
