Appeal Court Sacks Kogi Minority Leader

Justice Amiru Sanusi of an Appeal Court sitting in Abuja has sacked the Minority Leader of the Kogi State House of Assembly, Solomon Afolabi Oluyori. The judge upturned an earlier judgement delivered by Justice Inyang Ekwo of a Federal High Court in Lokoja, Kogi State.

The lawmaker was dragged to court by one Yakubu Kayode, who claimed he (Kayode) was wrongly substituted for Oluyori by his party, the defunct All Nigeria Peoples Party, ANPP, which merged with other parties to form the All Progressives Congress, APC.

The sacked legislator represented Ijumu constituency in the state Assembly and was made the minority leader of the House.

Justice Sanusi ruled that the Kayode’s appeal had merit based on the available facts before it. The presiding judge therefore set aside the earlier verdict delivered on September 30, 2011, declaring that the appellant was the rightful candidate of his party in the April, 2011 House of Assembly election for Ijumu Constituency.

He then declared that the removal of Kayode by his party, ANPP, was “null and void”.
