PDP Loses Suit Against 4 Defected Governors

Justice Gabriel Kolawole of a Federal High Court sitting in Abuja has dismissed the suit filed against four ‘rebel’ governors by the Peoples Democratic Party, PDP, seeking to declare their seats vacant.

The party ran to the court to remove the governors, who defected from the PDP to the All Progressives Congress, APC, in 2013.

They are Governors Rotimi Amaechi of Rivers State, Rabiu Kwankwaso of Kano State, Aliyu Wamakko of Sokoto State and Abdulfatai Ahmed of Kwara State.

In his ruling on Friday, Justice Kolawole held that the originating processes filed by the PDP to initiate the action were invalid. He further said that absence of endorsement on the processes violated Section 97 of the Sheriff and Civil Processes Act.

Justice Kolawole added that the irregularities in service of a process on a party could only be ignored if such party decided to wave his rights.

Though five governors were initially dragged to court in the matter, but the name of Murtala Nyako was later struck out after he was impeached by the Adamawa State House of Assembly.
